Conflicto de competencia suscitado entre el Juzgado Quinto Laboral del Circuito de Cartagena y el Juzgado 33 Laboral del Circuito de Bogotá.

Considera la Corte que el Distrito de Cartagena es el lugar de residencia de la accionante y por tanto, el sitio donde se producen los efectos de la presunta vulneración o amenaza ius fundamental alegada.

En ese orden de ideas dispone que el Juzgado Quinto Laboral de dicha ciudad sea quien de manera inmediata tramite y adopte la decisión de fondo a que haya lugar respecto de la solicitud de amparo invocada.

  1. PRIMERO. DEJAR SIN EFECTOS el auto del auto del 28 de febrero de 2017 proferido por el Juzgado
  2. Quinto. Laboral del Circuito de Cartagena, mediante el cual dicha autoridad judicial no asumió el conocimiento de la acción de tutela interpuesta por la señora Magola del Carmen Flórez Vega contra la Dirección de Impuestos y Aduanas Nacionales, dentro del expediente ICC-2829.
  3. SEGUNDO. ORDENAR la remisión del expediente ICC-2829 al Juzgado
  4. Quinto. Laboral del Circuito de Cartagena, para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar, dentro de la acción de tutela presentada por la señora Magola del Carmen Flórez Vega contra la Dirección de Impuestos y Aduanas Nacionales.
  5. TERCERO. ORDENAR que, por Secretaría General, se comunique la decisión adoptada a las partes y al Juzgado 33 Laboral del Circuito de Bogotá.
